Anti-Cyber Crime Law is not Perfect

MANILA -- Malacañang admitted Thursday that the Cybercrime Prevention Act of 2012 has several defects, but said the law's implementation could not be stopped and its flaws can only be addressed through amendments.
"(It) is not perfect," said presidential spokesperson Edwin Lacierda.
"We believe that since there has already been a clamor and you have seen that our position from the very start is: If you want to refine the law, you want to amend the law, well and good. These are provisions which you find objectionable primarily on the penalty on libel, on the takedown clause, then amend it," he added.
Lacierda said there are two ways to amend the controversial law. One is by questioning the law before the courts, and the other one is through Congress amending the objectionable provisions.
He said the Palace respects both avenues.
Malacañang is not keen on suggestions to repeal the law, saying the bulk of it primarily deals with addressing cybercrime, which is not punishable under a law before.
Lacierda said they are leaving it up to the lawmakers to make the appropriate amendments to law "based on the concerns raised by the public."
However, he added that the communications group led by Secretary Ramon Carandang might also suggest own amendments to Republic Act (RA) 10175 during the consultation in the crafting of the implementing rules and regulations by the Department of Justice scheduled on October 9.
The consultation will be open to the media.
"We hope that the consultation will clear the waters on questionable provisions of the law," he said.
Among the controversial provisions of the law is the insertion of online libel, which has stiffer penalties than that provided under the Revised Penal Code.
Another is Section 19 or the "takedown clause," which empowers the Justice Secretary to shut down websites with harmful contents.
Lacierda said the President could not stop the implementation of the law since the Executive is tasked to execute a law.
He said the ball is in the legislative if they decide to adopt a joint resolution to postpone the law's implementation.
Justice Secretary Leila de Lima echoed Lacierda's statement in turning down the call of Senator Edgardo Angara to suspend the implementation of a provision in RA 10175.
De Lima said Angara's suggestion is easier said than done, considering that the mandate of the Department of Justice (DOJ) is to enforce the law.
"No legislator can unilaterally ask for a suspension of a law, nor can we decide to suspend (its implementation)," she said.
What the justice department can do, de Lima said is to clarify the vague provisions in the law's implementing rules and regulations (IRR), which is yet to be crafted.
"On the ground, we will just be judicious on first few cases to allay fears of abuse or excesses in the exercise of such power and also to gain (the) trust (of the people)," she said.
Angara, who was the principal author of the controversial law in the Senate, earlier said that concerns raised by netizens on Section 19 of the law may be cured if the DOJ will suspend its application until the necessary amendatory law, which he and other senators who signed RA 10175 will file, has been passed.
Section 19 allows the DOJ to issue an order or restrict or block access to websites found to be in prima facie violation of the provisions of the controversial law. It also allows the justice department to take down or shutdown a website if it had been "hacked."
Angara also allayed fears that a “liker” of a libelous comment in social networking sites like Facebook and Twitter will also make him or her liable under the controversial law.
Angara clarified that there is misapprehension that Section 24 of the law will send “liker” or “sharer” of the libelous comment to jail.
“This provision is misapprehended. It’s not covered at all,” the senator said.
The lawmaker also said the solution is not to decriminalize the libel provision of the law but to amend the Revised Penal Code, which was the source of the libel provision of the law.
“I’m just saying to those who want to repeal libel provisions in the cybercrime law, that is still ineffective because libel would still be a crime because it is under our basic criminal code,” Angara said.
He also allayed fears by some media practitioners that their rights will be violated by the law.
The senator said he will propose to the DOJ to refrain from issuing such orders until upon approval of the courts.
The DOJ, together with the Department of Interior and Local Government and the Department of Science and Technology, are tasked to provide the IRR for the law.
Popular political satirist-blogger Marcelo Landicho, more popularly known in social media as the "Professional Heckler," was among the group of bloggers who filed on Thursday the tenth petition assailing the RA 10175, which they referred to as cyber-Martial Law.

Dwight Howard Traded to Lakers
EL SEGUNDO, Calif. -- An image Los Angeles Lakers fans have been dreaming of for two years finally became a reality Friday night as Dwight Howard held up his newly minted Lakers jersey for the first time at the team's training facility.
Sitting on the Lakers' practice court with 10 Larry O'Brien trophies staring down at him from Lakers executive vice president Jennie Buss' office and 12 championship banners and eight retired jerseys surrounding him on the walls, Howard quickly was introduced to the expectations that now will be placed on him before he even addressed the media.
"There's been a lot of speculation regarding Dwight being traded for the last six to eight to 10 months to a year," Lakers general manager Mitch Kupchak said. "Today, the speculation finally comes to an end. And we're hopeful that 10 years from now, we can add a jersey to that wall over there that says Dwight Howard."
There's no question the ordeal took longer than Howard, the Orlando Magic and everyone involved would have liked, but Howard finally got his wish to be traded from the Orlando Magic on Friday.
In the process, the Lakers were able to pick up the most dominant big man Los Angeles has seen since Shaquille O'Neal, who left Orlando to come there 16 years ago last month.
Howard now joins a storied lineage of Lakers big men dating back to George Mikan, Wilt Chamberlain, Kareem Abdul-Jabbar and O'Neal, who all led the Lakers to championships after joining the team.
"I don't want to try to compete with those guys," Howard said. "I want to bring my own flavor to L.A. I saw a picture last night. It was like the Mount Rushmore (of Lakers centers) and they had all those guys up there and said, 'Will he join the list of heads with the Lakers greats.' I want to be great in my own right. I want to write my own history and today is the first day of that history."
Howard let out a big sigh and flashed a big smile when he finally was given his No. 12 Lakers jersey and held it up for the first time. He inspected it from front to back before carrying it around the rest of the day, peaking at it from time to time to make sure it was real.
"It's kind of unreal," Howard said. "It finally happened. It's here. Just walking around upstairs and driving here ... I'm really a part of the Lakers. It hasn't really hit me yet. I'm just happy to be here and I'm going to make the best out of it."
It took four teams, 11 other players, five draft picks and countless rounds of talks over many months, but the Magic decided the time was right to start over without the NBA's best center and end a saga that has dogged the franchise for what seems like an eternity.
"Are we taking a step back? Absolutely, we are," Magic general manager Rob Hennigan said. "But we're taking a step back with a vision."
A lot of players found new homes in the blockbuster, including Andrew Bynum, sent by the Lakers to the Philadelphia 76ers. The 76ers sent Andre Iguodala -- part of the U.S. Olympic team that advanced to the final of the London Games on Friday -- to the Denver Nuggets.
Kupchak was not as definitive on Howard signing a long-term deal with the team next year, admitting the Lakers have yet to discuss an extension with him and took a gamble that Howard will re-sign with the team next year after he experiences a season in Los Angeles with teammates such as Kobe Bryant, Steve Nash and Pau Gasol.
"Our feeling was, no matter what anyone says, let's just get him to Los Angeles and we'll take our chances," Kupchak said. "It's the organization, ownership, the city of Los Angeles, our ability to win games, surrounding Dwight with players that will make it easier for him to play the game and not have to burden a load that's maybe not fair."
One source briefed on Howard's plans told ESPN.com's Marc Stein the All-Star center will indeed stand firm on his intent to play out the 2012-13 season without extending his contract so he can become a free agent on July 1, 2013. Going that route will enable Howard to decide how comfortable he is in Los Angeles before deciding whether to re-sign with the Lakers or join the Dallas Mavericks, who will have the requisite salary-cap space to sign Howard and who remain one of his preferred destinations from his original list of three teams (Nets, Lakers and Mavericks).
"If Los Angeles doesn't work out for Dwight, Dallas will be there waiting for him," the source told Stein.
While Howard wouldn't commit to the Lakers past this season, he sounded like a player who looked forward to learning from Bryant, Nash and Gasol and one day taking over the reins of the Lakers.
"I want to be a great leader and I have an opportunity to learn from the best in Kobe on how to lead a team," Howard said. "In order to be a great leader, you have to learn how to follow. I'm looking forward to following in the steps of Kobe Bryant in how he leads a team and Steve Nash and Pau. I'm looking forward to learning a lot from those guys because one day I want to be the guy that leads the team to a championship and this is a perfect time to start."
The Lakers pulled off the deal and somehow kept Gasol in the process -- something many didn't expect when the Lakers first started getting mentioned in the Howard trade mix.
The trade was announced during the Spain-Russia semifinal matchup at the Olympics. Gasol scored 16 points, helping the Spanish team reach the gold-medal game with a 67-59 win.
Gasol admitted that he struggled to keep his focus fully on Spain's victory.

Palace suspends classes in NCR, 9 provinces

MANILA, Philippines - Malacañang is suspending classes on all levels, including post-graduate courses, in Metro Manila and 9 provinces including Zambales, Bataan, Pampanga, Pangasinan, Tarlac, Bulacan, Laguna, Cavite and Rizal on Thursday, August 9.
Executive Secretary Paquito N. Ochoa, Jr. issued Memorandum Circular (MC) No. 34 announcing the suspension of classes, according to Presidential Spokesman Edwin Lacierda.
He said work in government and the private sector will resume tomorrow.
The Metro Manila Development Authority also announced that number coding is lifted tomorrow, August 9, in Metro Manila including Makati.

Human Guardian Class Build (Stunner/PvE/PvP)The walking stunner! or Human Guardian lol. This class is fun to play and
has alot of options. This is a powerful build for the human guardian
which will leave mobs powerless and frustrate your enemies. When
playing in PvE give each mob a stun and it will make short work of them
and you won’t receive only light scratches. Some of your early stun
spells include Psychic Crash and Charge. A later spell, Rush
can paralyze your enemies for 6 seconds. This also great for boss
hunting as you can feed them a steady dose of stuns. This is not as
effective on larger bosses though. Soloing is pretty easy with this
build but high mob leveling party grinding is great since you can tank
and stun before the mobs can get to the damage dealers. You have plenty
of firepower to dish out some devilish damage. Guardians have alot of
buffs that improve your already high strength and boosts your melee
damage too. This build has high health so that you can tank multiple
mobs. Stone Skin will leave you immune to all physical damage for 30 seconds at level 5 leaving mobs and pvpers at wits end. Order Swing
can deal devasting blows as it accumulates a percent of your damage and
applies it to the next attack for 30 seconds. In pvp most people won’t
want to mess with you. You have access to a DoT called Bleeding and
you have the ability to send a constant barage of stuns leaving them
helpless. With great offensive power and health you can make short work
in PvP. And you had better kill them fast lol. The thing you have to
worry about is your mana pool, its so low and you don’t have any real
way to replenish it skills wise besides using pots. The only real skill
is passive and uses a certain amount of mana per second to use called Divine. 8% chance to absorb 10% of damage dealt to your mana pool. A great skill to use on melee based pvp is Crazy Standing,
insane attack speed and powerful boost in damage dealt! You will only
be able to do basic critical damage since the stats in this build do not
have any DEX which is required for the critical damage boost. Overall
this build and this subclass is fun to play with the high/second stuns
you can do. Just remember to go easy on your mana supply and don’t
deplete it so quickly before your mana pot cools down. If you get down
pretty low you can use the Drain Blue spell which at level 5 applies 300% of your damage to your enemies mana!
1. Level 5: Increases Light Attribute Attack by 100% and Light Attribute Defense by 50%. 8% chance of absorbing 10% of the damage dealt as MP.

No classes, gov't work in Metro Manila, and other areas
MANILA, Philippines (UPDATED) - Malacañang has ordered the suspension of college classes and work in government offices in Metro Manila and other areas Tuesday because of heavy rains and floods.
The other areas covered by Memorandum Circular No. 33, series of 2012 that was signed by Executive Secretary Paquito Ochoa, Jr. are Zambales, Bataan, Pampanga, Pangasinan, Tarlac, Bulacan, Laguna, Cavite, and Rizal.
Ochoa, in the memorandum said decision to suspend classes and work was based on a recommendation made by the Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) amid the heavy rains being experienced in Metro Manila and nearby provinces.
"However, those agencies whose functions involve the delivery of basic and health services, preparedness/response to disasters and calamities, and/or the performance of other vital public services shall continue with their operations and render the necessary services," the order said.

Death toll rises to 51
Meanwhile, the death toll from over a week of floods in the country rose to 51 as rain continued to pour, causing dams to overflow and forcing more people to flee their homes, officials said Monday.
The number of deaths, previously at 45, rose as more bodies of missing people turned up, with one man drowning early Monday, said civil defense chief Benito Ramos.
Six people remain missing, including children who went swimming despite the bad weather that began last week as Typhoon Gener approached the country, he added.
Although the Philippines escaped a direct hit, it worsened monsoon rains which continued even after the cyclone moved north, away from the Philippines.
"They have been evacuating more people since this morning. The waters are still rising because it just keeps raining," Ramos told AFP.
La Mesa Dam, the main reservoir of Metro Manila, which has a population of 15 million, began to overflow Monday, forcing the evacuation of over 1,000 residents living beside nearby waterways, the Metro Manila flood control office said.
However, more people still remain in these areas, many of them squatters who built shanties on riverbanks, said Edna Conda, duty officer at the National Disaster Risk Reduction and Management Council.
"Often they don't want to leave. They say they are used to floods but we don't want to take chances," she said.
In the residential suburb of Quezon City, some areas reported floodwaters reaching the second floor of buildings, forcing various government agencies to rush rubber boats to the area, Conda said.
Other parts of the capital suffered knee- to waist-deep floods snarling traffic for hours, authorities said.
Even before the dam overflowed the government had more than 9,000 people huddled in makeshift evacuation centres, such as schools and basketball courts. - with a report from Agence France-Presse
